In the spring of 2021, the LAA served discovery requests to defendant Khalifia Hifter, requesting that he produce documents and provide responsive answers to questions submitted relating to his actions in Libya. The Hifter defense team objected to most of these requests on the basis of an asserted state secrets privilege. However, as Hifter’s defense team itself admits, there is no precedent for this privilege being applied to protect a foreign defendant from the disclosure of discoverable information. The victims defense team’s motion to compel will be heard before the court for a ruling on whether the state secrets privilege protects Hifter from responding to our discovery requests.
